Licensing

The Water Supply and Sanitation Act No. 28 of 1997 in part IV section 11(1) provides that a service provider shall not operate except under a licence issued by NWASCO. The license stipulates conditions under which the service provider will operate, as well as, the delineation of the operating area.

NWASCO is currently licencing 11 Commercial Utilities and four (4) Private Schemes for water supply and sanitation service provision countrywide.
Further, Section 21 of the Water Supply and Sanitation Act empowers NWASCO to suspend the licence of a provider on account of:

  • Giving false information
  • Transferring license without approval
  • Failing to comply with an enforcement notice
  • Failing to comply with provisions of the Water Supply and Sanitation Act or license conditions
  • Failing to provide water supply and sanitation service according to the Service Level Guarantees

When a decision is made to either suspend or cancel a licence, NWASCO issues a written notice of intention to the licence holder, giving them not more than 30 days to show cause why the licence should not be suspended or cancelled. The notice also outlines the shortcomings. When the stipulated time elapses without the provider correcting the situation or giving acceptable reasons for the poor performance, NWASCO will request the Minister responsible for water to appoint a Statutory Manager to manage the utility until such a time that service delivery is stabilised and/ or improved.
